Diaper Ownership and Equipment Responsibilities

1. Diaper Ownership

All diapers, diaper covers, inserts, accessories, wet bags, and other equipment provided as part of a Best Pal Bundle subscription remain the sole property of The Diaper Pal at all times.

Your Best Pal Bundle subscription provides you with temporary permission to use the equipment while your Best Pal Bundle subscription is active and in accordance with your selected Best Pal Bundle subscription plan. Your Best Pal Bundle subscription does not constitute a purchase of the equipment, and ownership is never transferred to you.

All equipment must be returned to The Diaper Pal when requested under this agreement, including when Best Pal Bundle subscription is paused, canceled, or terminated.

2. Care of Equipment

Customers agree to take reasonable care of all equipment provided by The Diaper Pal and to use it for its intended diapering purpose in accordance with the company's care instructions.

Normal wear and tear from ordinary, intended use is the responsibility of The Diaper Pal. Customers are not responsible for ordinary wear and tear but may be responsible for loss, misuse, or damage beyond normal wear and tear, as described below.

Please notify The Diaper Pal promptly if any equipment is lost, damaged, or otherwise unavailable for return.

3. Lost Equipment

If a diaper or other company-owned item is lost while in the customer's possession and cannot be located or returned, the customer may be charged the applicable fixed replacement fee listed in The Diaper Pal's Equipment Replacement Fee Schedule.

The fee schedule will identify the applicable charge for each type of item. Charges will be limited to the applicable disclosed fee for the missing item and will be administered in accordance with applicable law.

The Diaper Pal will make reasonable efforts to confirm missing items with the customer before applying a replacement charge.

4. Damaged Equipment

The Diaper Pal understands that cloth diapers and related equipment experience ordinary wear through regular use. Customers will not be charged for ordinary wear and tear or normal aging.

If equipment is damaged beyond normal wear and tear while in the customer's possession, the customer may be charged the applicable fee listed in the Equipment Replacement Fee Schedule when the item cannot reasonably be repaired or returned to service. Where a repair is appropriate and covered by the fee schedule, the applicable disclosed repair fee may apply instead.

Charges will be based on the condition of the item, the applicable fee schedule, and the circumstances of the damage, subject to applicable law.

5. Intentional Damage, Misuse, or Disposal

Customers may not intentionally damage, alter, sell, give away, discard, or otherwise dispose of equipment belonging to The Diaper Pal.

If intentional damage, misuse, unauthorized disposal, or other conduct results in an item being lost or rendered unusable, The Diaper Pal may charge the applicable disclosed replacement or repair fee, as appropriate, subject to applicable law.

Nothing in this section permits The Diaper Pal to impose an undisclosed or otherwise unlawful charge.

6. Equipment Return Following Cancellation or Termination

When a Best Pal Bundle subscription is canceled or terminated, the customer's right to use the provided equipment ends on the effective date of cancellation or termination, unless The Diaper Pal confirms a different arrangement in writing.

All company-owned equipment must be made available for pickup or returned through an approved return method within seven (7) calendar days after the effective date of cancellation or termination.

The Diaper Pal will communicate the available return arrangements and any applicable final pickup instructions. Customers agree to cooperate with those arrangements and ensure all equipment is ready for collection or return.

If equipment is not returned within the seven-day period, The Diaper Pal will contact the customer to arrange its return. If equipment remains unreturned, the applicable fixed replacement fee may be charged for each missing item, subject to applicable law and any required notice or authorization.

Payment of a replacement fee does not automatically transfer ownership of an item to the customer. Any equipment later located or returned will be handled in accordance with the applicable fee policy and law.

7. Final Pickup

The Diaper Pal will provide instructions for arranging the final equipment pickup following cancellation or termination. Customers are responsible for making all equipment available at the agreed-upon location and during the confirmed pickup window.

If a customer needs to change a scheduled final pickup, the customer must notify The Diaper Pal as soon as reasonably possible.

Any applicable pickup, rescheduling, or other service fees must be disclosed in advance and will be handled in accordance with the Best Pal Bundle subscription agreement and applicable law.

8. Diaper Bundle Subscription Pauses

If a customer requests or receives approval for a temporary Best Pal Bundle subscription pause, The Diaper Pal will arrange to collect the company-owned diapering equipment.

Customers must make all equipment available for collection at the agreed-upon time and location. The equipment remains the property of The Diaper Pal throughout the pause.

Equipment will be returned to the customer only when Best Pal Bundle subscription resumes and in accordance with the applicable Best Pal Bundle subscription arrangements. A pause does not waive outstanding payment obligations, equipment-return responsibilities, or any applicable fees disclosed in the service agreement.

Any pause-related service fees, scheduling requirements, or limits will be communicated to the customer before the pause takes effect.

9. Missed Pickups

Customers are responsible for making equipment available at the designated pickup location and during the agreed-upon pickup window.

If a scheduled pickup cannot be completed because the customer fails to make the equipment available or otherwise prevents the agreed-upon collection, a missed-pickup fee of $40 may apply.

The Diaper Pal will communicate the missed pickup and provide instructions for rescheduling or arranging another approved return method. Any applicable additional pickup fee will be disclosed before the customer confirms the rescheduled Best Pal Bundle subscription.

A missed pickup does not change ownership of the equipment or eliminate the customer's obligation to return it.

10. Customer Relocation

Customers must notify The Diaper Pal promptly if they move or their service address changes.

Continued service at a new address depends on whether the new location is within The Diaper Pal's service area and whether service can reasonably be provided there.

If The Diaper Pal cannot continue service at the new address, the Best Pal Bundle subscription will be handled under the applicable cancellation terms. All company-owned equipment must be returned within seven (7) calendar days after the effective date of cancellation or termination, using an approved return method.

Moving outside the service area does not transfer ownership of the equipment or eliminate the customer's obligation to arrange its return.

11. Equipment Replacement Fee Schedule

The Diaper Pal retains ownership of all diapers, covers, inserts, wet bags, and other equipment provided as part of a Best Pal Bundle subscription. Customers are responsible for returning all company-owned equipment in accordance with this agreement.

If an item is lost, not returned within the required return period, or damaged beyond normal wear and tear and cannot reasonably be repaired, the applicable fixed replacement fee listed below may be charged, subject to the terms of this agreement and applicable law.

EquipmentFixed Replacement Fee

All-in-One Diaper$15.00

Diaper Cover$10.00

Diaper Insert$5.00

Flat Diaper$5.00

Wet Bag$10.00

Normal wear and tear resulting from ordinary, intended use will not incur a replacement charge. The Diaper Pal will make reasonable efforts to confirm missing or damaged items with the customer before applying a charge.

Replacement fees are intended to cover the cost of replacing company-owned equipment. Customers will be informed of applicable fees before agreeing to their Best Pal Bundle subscription terms. Any charges will be applied in accordance with this agreement and applicable law.

Payment of a replacement fee does not automatically transfer ownership of an item to the customer. If an item previously charged as lost or unreturned is subsequently located or returned, The Diaper Pal will review the circumstances and handle any adjustment in accordance with its refund policy and applicable law.

12. Communication and Resolution

The Diaper Pal aims to handle equipment-related issues fairly and reasonably. Customers agree to communicate promptly about missing items, damage, pickup scheduling, changes of address, Best Pal Bundle subscription pauses, and cancellation arrangements.

The Diaper Pal will make reasonable efforts to communicate applicable fees, provide return instructions, and resolve equipment-related questions before applying a disputed charge where practicable.

All charges, return obligations, and remedies under this section are subject to applicable law and the other terms of the customer's service agreement.

13. No Refunds Policy – The Diaper Pal

All payments made to The Diaper Pal for Best Pal Bundle subscriptions and services are non-refundable, except where required by applicable law.

Due to the nature of our cloth diaper rental, laundering, and weekly exchange service, we do not offer refunds for subscription payments, prepaid service packages, unused service time, missed exchanges, or partial billing periods.

Recurring Subscriptions: The Best Pal Bundle subscription is billed every four (4) weeks. Customers are responsible for managing their subscriptions and requesting cancellation in accordance with The Diaper Pal’s cancellation policy. Cancellation does not entitle the customer to a refund for any payment already processed.

Prepaid Packages: Payments for prepaid 3-, 6-, and 12-month service packages are non-refundable once purchased, except where required by applicable law.

Service Interruptions or Missed Exchanges: No refunds or credits will be issued for missed exchanges, customer unavailability, or circumstances that prevent the customer from receiving or using the service, except where required by applicable law or expressly approved by The Diaper Pal.

Subscription Cancellation: Customers may request cancellation in accordance with the cancellation terms outlined in The Diaper Pal’s Terms of Service. Cancellation stops future subscription renewals as applicable but does not automatically qualify the customer for a refund of previous payments.

By purchasing a Best Pal Bundle subscription or prepaid service package, the customer acknowledges and agrees to this No Refunds Policy.

For questions regarding billing, subscriptions, or service concerns, please contact The Diaper Pal directly.

14. Subscription Cancellation and Billing Policy

Recurring Best Pal Bundle Subscription

The Best Pal Bundle subscription is billed automatically every four (4) weeks using the payment method provided at checkout. By enrolling, customers authorize The Diaper Pal to process recurring payments according to this billing schedule.

How to Cancel

Customers who wish to cancel their recurring subscription must submit a cancellation request directly to The Diaper Pal at least 7 calendar days before their next scheduled billing date. This notice period allows us time to process the cancellation and coordinate the return of rental equipment.

Cancellation requests must be submitted through the contact method designated by The Diaper Pal. E mail The Diaper Pal at hello@thediaperpal.com. Please indicate in the subject line: CANCELLATION

Customers are responsible for allowing sufficient time for their request to be received and processed.

Upcoming Payments and Refunds

If a cancellation request is received fewer than 7 calendar days before the next scheduled billing date, the upcoming payment may still be processed. If the payment has already been processed or can no longer be stopped, the cancellation will take effect for the following billing cycle, and the payment will remain non-refundable except where required by applicable law.

Once a cancellation has been processed, no further recurring subscription payments will be collected. Cancellation does not entitle customers to refunds for previous payments, unused service time, or partial billing periods, except where required by applicable law.

Return of Rental Equipment

All diaper covers, prefold diapers, inserts, wipes, wet bags, and other items owned by The Diaper Pal must be returned in accordance with the Equipment Responsibilities and Return Policy. Customers must coordinate the return of all rental equipment with The Diaper Pal. Cancellation of a subscription does not eliminate the customer's responsibility for unreturned or damaged equipment, as outlined in our equipment terms.

Prepaid Service Packages

Customers who purchase prepaid 3-, 6-, or 12-month service packages should review the applicable package terms before purchasing. Prepaid packages are non-refundable except where required by applicable law. Cancellation of participation before the end of the prepaid service period does not automatically entitle the customer to a refund.

Questions or Assistance

Customers may contact The Diaper Pal with questions about cancellation, upcoming billing dates, or equipment returns. We encourage customers to contact us as early as possible to avoid unexpected charges.

By purchasing a Best Pal Bundle subscription or prepaid service package, customers acknowledge and agree to these cancellation and billing terms.
